knew about the sex abuse happening or allegedly happening involving jerry sandusky. michelle, as i understand it this is the testimony that paterno gave to the grand jury and for the first time it's read out and we are hearing more detail and what he said to the grand jury. >> that's right. joe paterno is suffering from health problems and he is not here in court. we are not certain whether he was asked to come here, but they read a statement from the grand jury report and this was an interview done in january of 2011. this is where that took place. joe patermo being asked if he was contacted by then assistant mike mcqueary about what he witnessed in the shower in 2002. mcqueary said he 4 gone to paterno saying he had seen jerry sandusky with a boy in the shower. in paterno's words, he said in the deposition he was told that there was a older mature man in the shower and mcqueary mentioned that he thought sandusky was fondling that boy. when asked about what actions paterno took he said that he referred this information to his athletic director at the time. that was tim curley. cur

testified when he went to his locker to put in new tennis shoes he could see a reflection of jerry sandusky and the boy in the mirror in the shower. to make sure he saw what he thought he saw he looked over his shoulder into the shower and i believe that jerry was having intercourse with him. there was no screaming, protests or yelling. later he said i can't say 100% sure that is what was occurring. he turned back to his locker and slammed it shut and looked back and said that they stood five feet apart from each other and looked at him and he looked directly at them. he said that sandusky's face looked blank. mcqueary said when he met with the president and athletic director nine or ten days later he told them it was sexual intercourse over the line and there is no question in my mind that i conveyed to the them. i saw jerry with a boy in the shower and there was weird sexual acts going on in the shower. he testified the whole meeting lasted ten or 12 meetings. attorneys say they told the grand jury the truth as they knew it that mcqueary never gave them this description. >>> a judge ruled

coach jerry sandusky is in court facing new sexual abuse charges. sandusky was cuffed and arrested at his home on yesterday. well, the new charges involve two more alleged victims, bringing the total now to ten. it is believed that the two came in contact with sandusky as his second mile charity. let's go down to cnn's jason carroll who joins us from state college, pennsylvania live. jason, we're expecting sandusky to be bailed out today. then what? >> reporter: well, first of all, let's talk about what he gets bailed out. we do know that just about half an hour ago his wife left his home which is located about 20 minutes from now. not sure if that's any sort of indication in terms of whether or not he might be released soon. currently being held on $250,000 bail. if he's able to post bail, don, he'll be unvery tight restrictions. he'll essentially be under house arrest. he'll have to wear an electronic monitoring device while he's under house arrest. in addition to that, he'll not be allowed to have my contact with victims or possible witnesses in the case and another condition of
